Scheduling, Cancellations, Rescheduling

If you are unable to keep your scheduled appointment, please give at least 24 hours notice for rescheduling. Cancellations or rescheduled appointments (other than those due to unforeseen weather conditions) with less than 24 hours may be subject to a €50 cancellation fee.
Weather Policy

Living in the Algarve, the weather is normally a done deal. I am normally on top of up coming weather forecasts for wherever I am plannning to be shooting and will let you know if there is any chance of unfavourable weather. However, in the event of inclement weather on the day of the shoot, you may opt to reschedule for the next vancancy I have or proceed regardless of weather conditions. In this case, please know that your images will reflect the weather conditions at the time of the shoot. If weather conditions are too severe for sensitive camera equipment (heavy rain, high winds, etc), I may, at my sole discretion, reschedule your shoot for the next available vacancy.
Property Condition & Shoot Preparation

Property Shoots are very normally scheduled “back-to-back,” with just travelling time separating them. Therefore preparation prior to my arrival will ensure you get the best photographs taken during your appointment time. It is the property owners /Managers responsibility to ensure the property is shoot ready. I may make minor adjustments to improve the shot in some situations, but I will not move furniture or make significant changes nor will I clean the property.
Please ensure that there are no hazards to my safety and that pets are confined out of view.
All images are edited, but I retouching images to disguise known defects and/or physical structures such as wall/floor blemishes, cracks, power lines may result in additional fees applied.

Usage Rights
Real Estate Agents / Local Accommodation Agents / Marketing Purposes
The CLIENT is granted a license to use property images, for which they have paid, for the promotion of that property while CLIENT manages the listing. The License to use images expires once property has Sold, listing has Expired or is Withdrawn or based on alternative written agreements.
Images must not be edited/altered by anyone other than Daryl Gabin.com with the exception of minor cropping and/or resizing only to suit CLIENT website requirements.
CLIENT may NOT give or sell images to anyone. This includes the property owner, other Brokers/Booking Agents/Real Estate Agents, Constructors, Architects, Stager or any other 3rd party.
Daryl Gabin.com recognizes that CLIENT may use an MLS and does not control how images are shared by the MLS systems or how they may be syndicated to other property listing sites. Therefore, CLIENT is not liable for such usage beyond license expiration.
Disregarding these terms will result in copyright infringement/violation and may result in legal action.

Payment Terms

Payment is due upon booking or on the day of your shoot unless otherwise agreed to in writing. Payments may be made securely online, or by cash on the day of the shoot. Failure to make payments voids any license granted and constitutes copyright infringement.
Travel Expenses

For all assignments there is travel time and expense involved. Sometimes these expenses are covered in the fee, sometimes they will be additional expense to the assignment fee.
In all circumstanses, these details will be covered in pre-assignment documentation along with all relative contractual details.
